Please note that due to the rescheduling of the next meeting of the Criminal Justice Coordinating Council (“the Council”), the NOTICE OF PROPOSED RULEMAKING, dated February 11, 2022, has been rescinded and replaced with the following:


All interested parties are hereby notified, pursuant to O.C.G.A. § 50-13-4, that Council intends to consider amending the following rules:

144-4-.06 Crime Victims Compensation Board 144-4-.07 Unclaimed Restitution
144-4-.08 Forensic Medical Exams ("  MEs")
144-4-.09 Forensic Interviews ("FIs")


SYNOPSIS AND EXPLANATION OF PROPOSED RULES

The Georgia Criminal Justice Coordinating Council is tasked with administering the Crime Victims Compensation Program pursuant to O.C.G.A. § 17-15-1, et. seq.


During the 2021 legislative session, the General Assembly enacted House Bill 141 stipulating that, “…payments made by the Crime Victims Compensation Board to medical service providers for compensation for medical services shall be made in accordance with the list of usual, customary, and reasonable charges for medical services published by the State Board of Workers' Compensation…” The Bill also provides that, “[p]ayments made to and accepted by a medical provider shall be considered payment in full…” Rule 144-4-.06 has been updated to reflect the new law by adding paragraph (6) and adding the definition of “health care” in subparagraph (2)(f).

An additional amendment is proposed to Rule 144-5-.06 (7)(b). This amendment clarifies eligibility criteria for claimants seeking compensation for loss of support.

No amendments are proposed for Rule 144-4-.07.

The proposed amendments to Rule 144-4-.08 provide clarification relating to payments for forensic medical exams. Language was also added related to audits of organizations that receive payments for forensic medical exams.

The proposed amendments to Rule 144-4-.09 provide clarification relating to payments for forensic interviews. Language was also added related to audits of organizations that receive payments for forensic interviews.

All written comments must be received by 2:00 p.m. on March 24, 2022. Interested persons may also participate in the proposed rulemaking by presenting comments orally at a public hearing to commence at 2:00 p.m. on March 24, 2022, at the State Bar of Georgia Conference Center, 104 Marietta Street NW, 3rd Floor, Presidents Boardroom, Atlanta, Georgia 30303. Oral presentations at the hearing may be limited to five (5) minutes per person in order to afford all interested persons an opportunity to be heard. Based upon full consideration of all written and oral comments regarding the above matters, the Council may reject or adopt the proposed rules or may make changes to the proposed rules.
