Notice of Hearing and Intent to Adopt Rules - Criminal Case Data Exchange Board
All interested parties are hereby notified pursuant to O.C.G.A. 50-13-4 that the Criminal Case Data Exchange Board (“the Board”) intends to consider adopting the following rules:

SYNOPSIS AND EXPLANATION OF PROPOSED RULES
In 2018, Senate Bill 407 established the Criminal Case Data Exchange Board under the Criminal Justice Coordinating Council for the purpose of promulgating rules for criminal e-Filing and overseeing statewide implementation of the Criminal Justice e-Filing project. As such and pursuant to O.C.G.A. § 35-6A-14, the Board intends to adopt the attached rules. The purpose of the proposed rules is to provide:
- a description of the Board,
- definitions of terms used in the rules,
- a method for interested persons to petition for promulgation, amendment or repeal of a rule, and
- information regarding the e-Filing of criminal cases in state and superior courts.
Interested persons may participate in the proposed rulemaking process by submitting their written comments to Robert Thornton, Division Director, Justice and Compliance Division, Criminal Justice Coordinating Council, 104 Marietta Street, Suite 440, Atlanta, Georgia 30303. All written comments must be received by 12:00 p.m. on December 10, 2018. Interested persons may also participate in the proposed rulemaking by presenting comments orally at a public hearing to commence at 9:00 a.m. on December 10, 2018, at the State Bar of Georgia Conference Center, 104 Marietta Street, 3rd Floor, Room 3, Atlanta, Georgia 30303.
Oral presentations at the hearing may be limited to five (5) minutes per person in order to afford all interested persons an opportunity to be heard. If you have a physical impairment and require assistance or have any questions regarding this notice, please contact the Criminal Justice Coordinating Council.
Based upon full consideration of all written and oral comments regarding the above matters, the Board may reject or adopt the proposed rules or may make changes to the proposed rules.
The Board intends to consider adopting the rules at its meeting at 3:00 p.m. on December 10, 2018, at the Georgia Technology Authority, 47 Trinity Avenue S.W., 7th Floor, GTA Boardroom, Atlanta, Georgia 30334.
